By creating an account or using Generative AIs, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy.

Generative AIs provides an AI-powered image generation platform that allows users to:

• Generate images from text prompts using artificial intelligence
• Edit and enhance images using our canvas editor
• Share and collaborate on creative projects
• Access templates and pre-made designs
• Participate in our community marketplace

To use our services, you must:

• Be at least 13 years old (or the age of digital consent in your jurisdiction)
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access to your account

You are responsible for all activities that occur under your account.

You agree NOT to use our services to:

• Generate content that is illegal, harmful, threatening, abusive, or harassing
• Create deepfakes or non-consensual intimate imagery
• Produce content that infringes on intellectual property rights
• Generate misleading content intended to deceive (e.g., fake news)
• Create content depicting minors in inappropriate situations
• Circumvent usage limits or abuse the service
• Attempt to reverse engineer or extract our AI models
• Resell or redistribute our services without authorization

Your Content

You retain ownership of the original content you upload to our platform. For AI-generated images, you are granted a license to use, modify, and distribute the generated content, subject to our usage policies and your subscription tier.

License Grant

By using our services, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and process your content solely for the purpose of providing and improving our services.

• Free accounts receive limited monthly credits
• Paid subscriptions are billed in advance on a monthly or annual basis
• Credits do not roll over to the next billing period
• Refunds are provided at our discretion and in accordance with applicable law
• We reserve the right to modify pricing with reasonable notice

The Generative AIs platform, including its code, design, AI models, and branding, is owned by Generative AIs, Inc. and protected by intellectual property laws.

You may not copy, modify, distribute, or create derivative works based on our platform without explicit written permission.

We employ automated and manual content moderation to enforce our policies. We reserve the right to:

• Remove or disable access to content that violates these Terms
• Suspend or terminate accounts for violations
• Report illegal content to law enforcement
• Modify our content policies as needed

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT:

• The service will be uninterrupted or error-free
• Generated content will meet your specific requirements
• AI outputs will be accurate, complete, or appropriate for all uses

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GENERATIVE AIS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL.

Our total liability for any claims arising from these Terms shall not exceed the amount you paid us in the twelve months preceding the claim.

You agree to indemnify and hold harmless Generative AIs and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use of the services
• Your violation of these Terms
• Your violation of any third-party rights
• Content you create or upload

We may terminate or suspend your account at any time for violations of these Terms or for any other reason at our discretion. You may terminate your account at any time through your account settings.

Upon termination, your right to use the services will cease immediately, and we may delete your content after a reasonable period.

We reserve the right to modify these Terms at any time. We will provide notice of material changes through email or a prominent notice on our platform. Your continued use after changes constitutes acceptance of the modified Terms.

These Terms shall be governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the courts of San Francisco County, California.
